Online Meats Public Website Conditions of Use

Please read the following terms and conditions carefully before continuing to use this web site. Online Meats does not accept any liability with respect to loss, damage, death or injury, including consequential loss or damage arising from any misinformation against products listed on the Online Meats website.
Terms of Sale
You agree that you will ensure that the information you provide to us is accurate, up-to-date and not misleading, and that we can rely on this information for the purposes of fulfilling your orders.
Individual Access
You accept that you are responsible for anyone accessing the Online Meats website using your nominated email address and password and that the login ID and password provided to you are for your individual use only. You will ensure that these details are not communicated to any third party, and that no other individual will log in using your account.
Your Status
By placing an order on the Online Meats website, you warrant that:
· You are legally capable of entering into binding contracts
· You are over 18 years old
· You are resident in urban New Zealand
· You are authorized to use the credit card verified for payment
· You must live within the boundaries of a designated urban area
Price and Payment
Orders must be paid for by credit or debit card (Visa or Mastercard). All prices displayed on the Online Meats website are stated in $NZD and include GST (15%). Online Meats does not store usable credit or debit card information. To pay for your order you will be transferred to the secure ANZ Bank portal that is PCI compliant.
Payment for your order will be processed on the date your order is ready for dispatch. You must ensure you have sufficient funds available on your credit or debit card to pay for the order on this date. If you have insufficient funds on that date, then your order will not be processed and the order will not be accepted. We may contact you to let you know the payment has failed.
You agree to indemnify (i.e. compensate) us against any loss or damage that we incur arising out of any default by your credit or debit card provider to make payment to us in full.
From time to time we may need to revise the price of the Products on the Online Meats Website, the new prices of the Products and the delivery charges will be as quoted on the Online Meats website. These prices are subject to change.
All product and delivery charges include GST.
We reserve the right to investigate all accounts where we suspect incorrect or fraudulent activity occurred. We reserve the right to terminate your order or accounts following the investigation.
Termination of Access
Online Meats reserves the right at their absolute discretion at any time to exclude any customer from the Online Meats Website; or cancel the registration of any customer.
Specials and Promotions
Products on special or promotion are subject to availability while stocks last.
Consent to Receiving Messages and Direct Marketing
When you register on the Online Meats website your contact details will be added to our customer database, and you consent to receiving messages from us from time to time if you have activated that function. All personal information collected by Online Meats will be held and used in accordance with our Privacy Policy. If you have provided us with your mobile number, we may send you a text message advising you of your order’s delivery status.

Online Meats operate the website located at www.onlinemeats.co.nz.
Service Availability
The Online Meats website is only intended for use by people residing in urban New Zealand (Service Areas). We do not accept orders from individuals outside those Service Areas. Customers must provide a valid email address and credit card for all orders accepted online. We do not accept private orders by phone.
Contract Formation Between You and Online Meats
After completing the registration process and completing an order, on the Online Meats website, you will receive an email acknowledging that Online Meats has received your order. Once the order has been accepted by Online Meats it will relate only to the Product you have ordered. Each Order that we accept results in a separate binding agreement between you and Online Meats for the supply of those Products. For each Order accepted by us, we will supply the Products in that Order to you in accordance with these Terms and Conditions.
Acceptance or Rejection of an Order
We reserve the right to accept or reject an Order for any reason, including but not limited to:
· Product out of stock
· Pricing has changed
· Incorrect information advertised on the Website.
If an order is rejected, we will endeavor to notify you within 7 days after you submit an Order.
Product Quality
Online Meats will endeavor to provide fit for purpose product, however there may be occasion where the transportation of the product fails resulting in a break down of the cold chain and the delivery of the product in less than perfect condition at the time of delivery. Should this occur Online Meats will follow its returns, cancelation and refunds policy.

Customer Guidelines for Quality Assurance & Issue Resolution
1. Responsibility Upon Delivery
Once the meat is delivered within the delivery timeframe, the responsibility for proper handling, cooking, and storage lies with the customer. To ensure the best quality, we recommend following the appropriate cooking techniques and instructions for each type of meat. Please note that improper cutting or overcooking can impact the tenderness and quality of the meat.
2. Product Quality Upon Opening
If you encounter any issues upon receiving and opening your meat—such as an unusual smell or visible signs of spoilage when the meat is uncooked and freshly opened from the package—we are here to help. Please take a photo of the affected meat and contact us immediately. This photo is crucial for our investigation and allows us to resolve the issue quickly.
3. Reporting Issues
Any issues with the meat must be reported as soon as possible, along with a clear photo of the product in question. This helps us investigate the situation thoroughly and work towards a solution that ensures your satisfaction.
4. Product Images Disclaimer
Product images displayed on our website are for illustrative purposes only and may not precisely reflect the item received. Minor variations in appearance are to be expected and accepted unless an incorrect product has been supplied, in which case we will assess the matter accordingly.
Risk and Title
The Products will be at your risk from the time of delivery to the Delivery Address or in accordance with your delivery instructions. Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products including delivery charges.
Disclaimer and Limitation of Liability
The following paragraphs exclude or limit our liability for your use of the Online Meats website.
While we have taken reasonable steps to ensure the accuracy, currency, availability and completeness of the information contained on the Online Meats website, that information is provided in good faith and on an `as is` and `as available` basis and we do not make any representation or warranty of any kind, whether express or implied, as to the reliability of the information.
Unfortunately, no data transmission over the Internet can be guaranteed as totally secure. We do not warrant and cannot ensure the security of any information which you transmit to us. Accordingly, any information which you transmit to us is transmitted at your own risk. Nevertheless, once we receive your transmission, we will take reasonable steps to preserve the security of such information.
To the extent permitted by law, we do not accept responsibility for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with your use of, attempted use of, or inability to use the Online Meats website, nor do we accept any responsibility for any such loss arising out of your use of or reliance on information contained on or accessed through the Online Meats website.
To the extent permitted by law: our total aggregate liability in connection with these Terms and Conditions is limited, at our option, to:

Rewards Program Information
Points Earnings and Redemptions:
- Points do not have any monetary value, except to the extent specifically provided for by a reward. Points have no cash value and are not exchangeable for cash or credit.
- Points will be awarded for each eligible transaction made at www.onlinemeats.co.nz.
- Points cannot be backdated nor transferred from other user accounts.
- Under no circumstances can points be sold.
- We withhold the point to limit point earning eligibility on discounted or promotional purchases.
Points will expire only if you have not earned or spent points for a continuous period of 6 months, or if you close your account. These points will be immediately forfeited and cannot be reactivated upon creating a new account.
If our loyalty program gets terminated by us, we will notify all loyalty users how long they have to use remaining points before final expiration. If we give you notice after termination, points will only continue to be credited to your Points Balance in relation to transactions that occurred prior to the date of termination. Any notice we give will include the general reasons for termination (if possible), and the time period available to you to use points in your points balance to claim rewards. We will define the time limit remaining before final expiration of all points.
Rights and Obligations
We may transfer, assign, charge, sub-contract or otherwise dispose of any of our rights or obligations arising under these Terms and Conditions, at any time without your prior consent.
Force Majeure Events
Online Meats is not liable or responsible for any failure to perform any of our obligations under these Terms and Conditions that is caused by events outside our control (Force Majeure Event).
· strikes, lock-outs or other industrial action; Government enforced social lock down (Covid 19 Level 3 and Level 4)
· Natural disaster such as but not limited to fire, explosion, storm, flood, earthquake, subsidence, epidemic
· Acts, decrees, legislation, regulations or restrictions of any government.
Online Meats performance under these Terms and Conditions is deemed to be suspended for the period that the Force Majeure Event continues.
Entire Agreement
Online Meats may in their absolute discretion change, amend or vary these terms and conditions. All decisions pertaining to any disputes arising from the conduct of Online Meats in the interpretation of the Terms and Conditions will be made by Online Meats, whose decision will be final and binding on all customers and suppliers.
General
Our failure to enforce any provision under these Terms and Conditions will not waive our right thereafter to enforce any such provisions.
These Terms and Conditions are governed by and are to be construed in accordance with the laws in force in New Zealand. Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of New Zealand.
